    Another thing I just noticed is a LUD on my I-140 which was approved a year ago ( july5th 2007)
    The lud happened on 7/27/2008.

    I haven't recd. any emails (CRIS for EAD) yet. But I noticed the same thing, I saw a LUD on 7/13 on my I-140 which was approved in 2006. wired.. don't know what's going on (my case EB3-I PD 5/2004).

    anybody has any idea?

    This guy is a deshi employer. He is on H1 so he is a silent partner & that why scratching his head.

    There are attorneys who will charge only after recovering money. The stupid employer can be sued for lost wages along with civil penalties from which the attorney's fee will be paid.


    You can view my past posts in IV, I am not Desi employer but I may become very soon to employ myself (very close to get GC :-) )

    Anyway have you gone through yourself with same situation/tension as OP going through or do you know someone closely who have gone through? Have you dealt with attorney yourself?


    If that employer sue you, definitely you can counter sue for violation of wage related or h1b related rules and attorney will be the best person to advice you on that. make sure you go to an attorney who practice employement laws and have knowledge or have some other attorney in the same firm who deals in immi related matter. But question is, do you want to go through nightmare of law suites or you just want peace of mind.

    When some one decides to apply AC21 by having an offer from another employer, it is not clear if one is required to inform USCIS about it. Some say one should, others say, not required. Has anyone seen any USCIS position on it? If not, perhaps we should make this as a question for next Ombudsman's conference call.

    I can't understand why Sanhari's suggestion would rile up EB2 folks. All he suggested was to use the EB spillover visas for oldest cases irrespective of EB category and country.

    Sanhari - Are you sure that this is a USCIS decision? Can USCIS change the way the do the spillover without legislation change?

    Folks, There is a another thread on here that says IV is neither against EB3 nor for EB2. If that's really the case why would Sanhari's suggestion not find favor? If IV seriously want to do something for the backlog, Sanhari's suggestion should be taken up.

    I anticipate and welcome reds, greens, blues for this post :)

    as gc28262 has indicated, that proper analysis and the correct interpretation of the law is needed to change such matters. Unless, EB3 people come out of the lethargic content/self pity and start working on the issues as if their life depended on it (it does) - just writing to the senators and representatives will not help. The legislative offices is not going to do the analysis (in the time that matters to us) and address it to the USCIS. However, if we do the ground work and then approach them, we may have a better chance of succeeding.

    Okay - so I know this is premature....but just today I logged into my CRIS account and I saw that they've touched my case on Aug 25th!!

    Probably not a big deal for anyone but MEEEE!!!

    And my priority date is July 17th 2006- so people there are numbers available for September. :) :)

    Got the CPO email at 11 PST today (8/24) !!!

    Priority Date: Feb 12, 2006
    EB2 India, NSC

    I opened an SR on 8/9 but I haven't received any response to it. I didn't do anything else.

    A huge Thanks to IV and everyone here - you kept the hopes up.

    I took a printout of the receiver's signature image and the tracking information from the Fedex website just in case.
    My attorney also mentioned that he submitted my case to the NSC liaison (I think he is referring to the AILA liaison of the NSC center) for follow up to see if they can help confirm the status of my application.
    I'll keep you posted on the progress.

    I am just trying to make list of people stuck on July 3rd at 9:03 received by R.William. Appears that our box is lost.

    Living off the wealth others have created?? What are you talking about? Also, this issue is not just about programmers. It is about doctors, scientists, engineers and several other qualified professionals. Do some fact-checking rather than being a nitwit. Go take a walk.



    Why don't posters on this forum move back to their home country and concentrate on making their home country great instead of slamming into someone else's country and just living off the wealth others have created?

    The bottom line is that a SKIL act is not needed. Hundreds of thousands of American programmers have lost their job to the third world, both in outsourcing and insourcing of third world programmers who work for cheaper wages. There is absolutely no need for more foreigners here and no need for more green cards. Temporary workers are just that - temporary. If you are on a temporary visa, work your time, make some money for your family and head home when your time is up. Don't cry that we don't provide enough green cards when you knew what kind of visa you were on.

    In the past week, the "Protest Blooms" campaign notched up the following wins:
    Times of India article
    Buzz in the blogosphere
    Attention from many attorney websites and blogs
    Had a Washington Post journalist show interest in our issue and had tens of our members talk to her - which should result in a good article. How many times have we seen so many regular members of IV being able to speak to a reporter of a mainstream US publication on our issues?
    Had a senior Reuters editor talk to many of us and he promised a sustained coverage of our issues
    Had a senior reporter from New York Times talk to me
    Had the footage of this entire event shown on CNN in India
    Had many small media outlets which never cover these kind of issues, cover it (in smaller towns in MN and NY)
    Created a sense of action in the community which was feeling pretty dejected after the USCIS fiasco
    Had USCIS director react to us
    Had so much interest generated that the IV website was brought down J
    Brought a great deal of attention to IV (see previous point)And all this was accomplished with a severe time crunch. The grassroots effort involved in this campaign was unbelievable - thanks to everyone who kept the faith.

    Was the point of this campaign to have our flowers be decorated on the desk of the director of USCIS? I don't think so. The word again was "symbolic" and that purpose is served whether the flowers are in boxes or in full view of the world.

    Would it have made for better visuals if the flowers were in full view? Sure. Is there a way to improve upon every campaign? Sure.

    Let us learn from what went right and what went wrong and use this to better execute all future events.

    It seems like the deeper we are in the process of GC the more time we spend tracking and speculating on the next week or the week after.

    This week is going to be critical for the Notices because if we don't get them by 8/17 the following weeks are going to be even worse.

    I'm tempted to call because of the time that has passed and becasue my checks also are dated 6/15.

    Its better to use rental car, as i did landing on june30, 2008 and the canadian customs asked me to either transfer the car or take it back to USA.

    so were u able to do landing? if yes, then how u did?

    Hi all,
    any advice/suggestion in my case:

    EB3
    I-140 is approved on Jun 15, 2007, Premium processing, in Texas

    I485 package delivered to Nebraska on July 2, 11:35 am and is singed by ... whoever..

    I've registered on the https://egov.uscis.gov/cris/jsps/index.jsp
    site and all times before LUD for my I140 was 6/16/2007 until today
    Today LUD for is updated to 8/12/2007.

    Checks have not been cashed.

    Please anybody is in the same sutiation???

    You are incorrect on multiple accounts.

    But, before going there, let me ask you this. What is your legal reasoning to dispute the case you have mentioned?

    The legal reasoning is "Civil Rights Act of 1964" which applies to all individuals employed by a US employer in the US and to US citizens employed by US employers outside the US.
